1. Overview
These Terms of Service ("Terms") govern your use of TheImageDept's website and the design, development, and related services we provide ("Services"). By engaging TheImageDept for a project or using this website, you agree to these Terms.
2. Services
TheImageDept builds custom websites, management systems, and automations for businesses. The specific scope, deliverables, timeline, and cost of a project are agreed with each client individually before work begins, typically following an initial conversation and a written quote.
3. Project Process & Payment
For website projects, we typically design and build the site before requesting payment, so you can review the finished work first. For management systems and automations, scope and payment terms are agreed on a per-project basis given the wider range of complexity involved. Any deposits, milestones, or ongoing fees will be set out clearly before work starts.
4. Client Responsibilities
To keep a project on schedule, clients agree to provide timely feedback, content, access credentials, and any other information reasonably requested. Delays in providing these may affect delivery timelines.
5. Intellectual Property
Once a project is paid in full, ownership of the final deliverable (the website, system, or automation built for you) transfers to the client, excluding any third-party tools, libraries, or licensed assets used to build it, which remain subject to their own licenses. TheImageDept retains the right to showcase completed work in its own portfolio and marketing, unless otherwise agreed in writing.
6. Revisions & Changes
Projects typically include an agreed number of revision rounds during the build process. Requests that fall outside the original scope may be treated as additional work and quoted separately.
7. Limitation of Liability
TheImageDept will make reasonable efforts to deliver reliable, functioning work, but we do not guarantee that any website, system, or automation will be completely uninterrupted or error-free. To the extent permitted by law, TheImageDept is not liable for indirect, incidental, or consequential losses arising from the use of delivered work.
8. Termination
Either party may end an engagement with reasonable written notice. In that case, the client pays for work completed up to that point, and TheImageDept provides whatever work-in-progress has been completed.
9. Governing Law
These Terms are governed by the laws of Ghana, without regard to conflict-of-law principles.
